1. Acceptance
By accessing or using Fix Your Face (“FYF,” “the Service”) you agree to these Terms of Service. If you do not agree, do not use the Service.
2. What FYF does
FYF is an AI-assisted communication tool that rewrites messages you provide into alternate tones. It is an editorial aid, not a substitute for your own judgment. You are solely responsible for any message you send after using FYF, including any consequences that result.
3. Your account
You must be at least 13 years old to use FYF. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
4. Acceptable use
You agree not to use FYF to:
- Generate content that is illegal, defamatory, harassing, or threatening.
- Generate content intended to deceive, defraud, impersonate another person, or facilitate identity theft.
- Generate child sexual abuse material, content that sexualizes minors, or any content prohibited by OpenAI's usage policies.
- Reverse-engineer, scrape, or otherwise circumvent the Service's technical limits or authentication.
- Resell, sublicense, or build a competing product on top of the Service without our written permission.
- Submit content you do not have the right to submit, or that violates anyone else's privacy or intellectual property.
We may suspend or terminate accounts that violate these rules, and may report illegal activity to law enforcement.
5. Plans, billing, and refunds
FYF offers a free tier with a daily usage limit and a paid Pro subscription with a higher daily limit and voice learning. Prices are shown before you subscribe. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before it ends.
Subscriptions bought in the iOS app are billed by Apple to your Apple ID and are managed or cancelled in your device's Settings under Subscriptions. Subscriptions bought on the web are processed by RevenueCat and Stripe and are managed from the link in your receipt email or from your account page.
Refunds for App Store purchases are handled by Apple under Apple's policies. For web purchases, and except where required by law, payments are non-refundable; if you believe you have been incorrectly charged, contact us within 30 days.
6. Content ownership
You retain all rights to the messages you submit. By submitting content, you grant us a limited, non-exclusive, royalty-free license to process, transform, store, and display that content for the sole purpose of operating the Service, including using your translation history to personalize future translations for your own account.
Outputs generated by FYF are provided to you for your use. We do not claim ownership of generated content. Per OpenAI's policies, ownership of model outputs sits with the user who requested them, to the extent allowed by law.
7. Service availability
We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We are not liable for any loss resulting from downtime, model errors, or changes to the Service.
8. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that translations will be accurate, appropriate, or free of unintended bias.
9. Limitation of liability
To the maximum extent permitted by law, FYF and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.
10. Indemnification
You agree to indemnify and hold FYF and its operators harmless from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party right.
11. Termination
You may delete your account at any time from your account settings. We may terminate or suspend your account if you violate these Terms. Upon termination, your right to use the Service ends immediately and your data will be handled according to our Privacy Policy.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to the exclusive jurisdiction of those courts.
13. Changes
We may update these Terms occasionally. Material changes will be announced via email or in-app banner before they take effect. Continued use of the Service after the effective date constitutes acceptance.
